- The contract form is invalid if it is just a plain private document. The contract provides for a loan of 40,000 EUR. For loans above 25,000 €, the law requires a public deed or authenticated private document Art. 1143.º CC.
- The 1% monthly interest rate is legally problematic. The contract sets Monthly interest payment of 1%, roughly 12% per year. In an unsecured civil loan, interest is usurious if it exceeds the statutory rate plus 5% Art. 1146.º CC.
- Inconsistency in how the money is delivered. It says the sum is handed over in cash, at the moment of signing, but later states the borrowers will receive the loan in the following bank account.
